TYPES OF PASSES

Passes are issued by immigration officers under Regulation 26 of the 2012 Act to applicants who meet the requirements on terms and conditions as specified.

Once issued, the Passes cannot be cancelled or varied before a holder is given sufficient notice and an opportunity to be heard.

There are various types of Passes which include, Dependent Pass, Special Pass, Kenyan Students Pass and Kenya Internship/Research Pass.

3.1 DEPENDENT PASS

A Dependent Pass is issued to a person whose spouse, parent or guardian is lawfully entitled to enter Kenya under Regulation 27(1) of the Kenya Citizenship and Immigration Regulations, 2012.

The Dependent Pass validity is dependent on the primary applicant lawful resident in Kenya. They must provide sufficient evidence that they are able to maintain their Dependents for the duration of their stay in Kenya.

It is illegal to undertake paid or unpaid work with a Dependent Pass. If a Foreign National who is a holder of a Dependant Pass wishes to undertake paid or unpaid Employment in Kenya, they must secure a valid Work Permit

Further, Children on Dependent Passes must also in addition obtain student Passes to enable them to be admitted to education institutions in Kenya.

The Pass shall be invalidated where the Dependent ceases to depend on the applicant or where applicant is unable to maintain the Dependent.


3.2 SPECIAL PASS/EMERGENCY WORK

PERMIT

This is a Temporally Work Permit issued to an applicant for a limited period of time whilst temporarily conducting business in Kenya or in circumstances the applicant has applied for a Work Permit and is awaiting the outcome of the same.

The Special Pass can also be applied whilst the applicant has applied for a review of the decision of the refusal of their Work Permit to the Cabinet Secretary or has applied for an appeal to the High Court.

3.3 KENYA STUDENT PASS

It’s mandatory for every person undertaking Education Studies in Kenya to obtain a Student Pass. A Dependent Pass is not a substitute to a student Pass, thus a holder of a Dependent Pass must in addition obtain a Student Pass

The parent or guardian of a person seeking to enter and remain in Kenya for the purpose of receiving Education or training at an Education Institution in Kenya may apply for a Student Pass.

Applicants from the East African Community seeking to enter and remain in Kenya as Students are required to also submit an application for a Student Pass to the Director of Immigration. Applications by members from the East African Community are exempt from paying the applicable fees.


3.3.3 Dependants of Students

The Dependant or Guardian of a holder of a Student Pass, can apply for a Dependant Pass in Kenya whilst the Student undertake their studies in Kenya.

The Student must however proof that they have sufficient funds to maintain and accommodate the Dependants or Guardians in Kenya.

In addition, the Dependants of a holder of a Student Pass who wishes to undertake Employment in Kenya can apply for a Work Permit in the relevant category they qualify under.

3.4 KENYA INTERNSHIP/RESEARCH PASS

This is a document issued to a person seeking to enter and remain in Kenya for the purpose of undertaking Internship or an academic research within Kenya.

The applicant must have been accepted as a Researcher or Intern in an Institution within Kenya.

The internship or Research Pass is valid for a period of 1 year.
